Refund & Cancellation Policy

1. About this policy
This policy explains when and how you may cancel your e MunshiJi subscription and when a refund is available.
e MunshiJi ("the Service") is operated by Divya Srivastava, sole proprietor, having its place of business at Gold Line Residency, Anora Kalan, Faizabad Road, Lucknow, Uttar Pradesh 226010, India ("we", "us", "our"). This policy applies to every subscription purchased through the Service, whether paid by UPI, card, net banking or any other method we support.
This policy is part of, and must be read together with, our Terms & Conditions and our Privacy Policy.
2. What you are paying for
e MunshiJi is a digital service delivered immediately and continuously. A subscription gives you the right to use the Service — draft generation, legal research, arguments, case diary and reminders — up to the limits of your plan (daily, or for Starter drafts, per paid month), for the duration of your subscription period.
You are paying for access to the Service, not for a fixed number of documents. Unused limits do not carry forward — a daily limit to the next day, or a monthly limit to the next month — and have no independent monetary value.
The Service produces drafts for an advocate's review. It does not provide legal advice, and the output is not a substitute for your own professional judgment. Dissatisfaction with the legal content, style or strategy of a generated draft is not, by itself, a ground for refund — see Clause 6.

Your subscription begins when we activate your account and confirm activation to you on WhatsApp, and runs for one month from that date unless stated otherwise.
Current billing: subscriptions do not renew automatically. Your access ends at the end of the paid period unless you choose to pay again.
If we introduce automatic renewal (UPI AutoPay or card e-mandate): we will tell you clearly before you set up any mandate, you will authorise it yourself, we will send you a notification at least 24 hours before each debit, and you may cancel the mandate at any time from your UPI or banking app, or by asking us. Clause 5.3 will then apply.
Free Trial. We may offer a complimentary trial period ("Trial") to new users, on terms stated within the Service at the time of the offer, ordinarily limited to one Trial per user and per mobile number. No payment is taken for a Trial, and accordingly Clauses 4 (Cancellation) and 5 (Refunds) below — which govern paid subscriptions — do not apply to it, since there is no payment to cancel or refund. When your Trial ends, unless you have taken a paid plan, your access automatically continues on our limited, no-cost tier rather than stopping altogether — you keep your case diary and hearing reminders, while drafting, arguments and case-law and bare-act search become part of the paid plans. We may change, shorten, extend, or discontinue the Trial offer at any time.
4. Cancellation
4.1 How to cancel
Send "रद्द करें" or "cancel" to us on WhatsApp at +91 70224 57957, or email help@emunshiji.in from the address linked to your account.
4.2 What happens when you cancel
- We will acknowledge your request within 2 working days.
- Your access continues until the end of the period you have already paid for, unless you ask us to terminate it immediately.
- No further amount will be charged to you.
- Where an automatic-payment mandate exists, we will cancel it from our side. You may also cancel it directly in your UPI or banking app.
4.3 Cancelling before activation
If you have paid but we have not yet activated your account, you may cancel and receive a full refund. This is unconditional.
5. Refunds
5.1 Cooling-off period
You may request a full refund within 7 days of activation, provided you have not generated any legal draft or any argument during that period. This applies to every paid plan.
Case-law search, the case diary and hearing reminders may be used during this period without affecting your right to a refund.
5.2 After the cooling-off period
Once the cooling-off period has passed, or once you have generated any legal draft or any argument, the subscription fee for the current period is not refundable, because the Service has been substantially delivered.
5.3 Auto-renewal charged in error
If an automatic renewal is debited after you have cancelled, or without the 24-hour advance notice required of us, we will refund that amount in full, without applying Clauses 5.1 or 5.2.
5.4 Duplicate or failed payments
- Double payment for the same period: the extra amount is refunded in full.
- Money debited but subscription not activated: refunded in full, or — if you prefer — activated with your consent.
- Payment failed but money debited by your bank: this is a bank or payment-gateway settlement issue. Tell us and we will trace it with the gateway. Such amounts are usually auto-reversed by the bank within 5–7 working days.
5.5 Prolonged service failure
If the Service is unavailable to you for a continuous period of more than 72 hours because of a fault on our side, you may ask for either an extension of your subscription by the affected days, or a pro-rata refund for those days. The choice is yours.
This does not apply to unavailability caused by your device or internet connection, by WhatsApp, by your telecom operator, or by any other event beyond our reasonable control.
6. When a refund is not available
We do not refund on these grounds:
- The draft was not what you expected in content, style, length or legal strategy. Every draft must be reviewed and edited by you before filing; this is stated in the Service, in the output document itself, and in our Terms.
- The draft contained a factual or legal error that your own review would have caught.
- The document you supplied was unclear, incomplete or illegible, and the draft reflected that.
- An adverse outcome in any court or proceeding.
- You did not use the Service, or used less than your plan's limit.
- You lost access because your account was suspended for breach of our Terms.
- The amount was consumed and the request is made after the current subscription period has ended.
Failed generation is handled automatically, not by refund. If a draft fails for a technical reason at our end, the Service does not count it against your limit. If you believe a failed draft was counted, tell us and we will restore it.
7. How to request a refund

- the mobile number registered with your subscription;
- the date and amount of payment, and the UPI transaction / reference number; and
- the reason for your request.

Refunds are made only to the original payment method and account from which the payment was received. We do not refund to a different account, in cash, or as credit adjustment, unless the original method has genuinely ceased to exist.
If we reject a refund request, we will tell you the reason in writing.
8. Chargebacks
If you raise a chargeback or payment dispute with your bank instead of contacting us first, we may suspend your account until the dispute is resolved. Please contact us first — it is faster, and almost every issue is resolved without involving your bank.
9. Changes to price or plan
We may revise prices or plan limits. Any revision applies only from your next subscription period, never to a period you have already paid for. We will tell you before it takes effect. If you do not accept the revision, you may simply not renew.

The Grievance Officer will acknowledge your complaint within 48 hours and resolve it within one month of receipt, in accordance with the Consumer Protection (E-Commerce) Rules, 2020.
You retain every right available to you under the Consumer Protection Act, 2019. Nothing in this policy limits those rights.
11. Governing law and jurisdiction
This policy is governed by the laws of India. Subject to the Consumer Protection Act, 2019, the courts at Lucknow, Uttar Pradesh, shall have jurisdiction.
